  • House Bill 4045 of 2013 - Amends the Electrical Administrative Act to remove a provision requiring apprenticeship training programs for fire alarm specialty apprentice technicians be equivalent to the standards set forth by the U.S. Department of Labor.  The bill separates the apprenticeship training programs for electricians and fire alarm technicians.

  • House Bill 4591 of 2013 - Amends the Electrical Administrative Act, sections 6 and 7, to allow a system provider under the Security Alarm Systems Act, 2012 PA 580, or a security alarm system contractor under the Private Security Business and Security Alarm Act, 1968 PA 330, to install, maintain, replace, or service any electrical wiring, equipment, or devices associated with the installation, maintenance, replacement or servicing of a security alarm system or a home monitoring system.

  • House Bill 4592 of 2013 - Amends the Forbes Mechanical Contractors Act, sections 7 and 9, to allow a system provider under the Security Alarm Systems Act, 2012 PA 580, or a security alarm system contractor under the Private Security Business and Security Alarm Act, 1968 PA 330, to install, maintain, replace, or service a thermostat without obtaining a licensed under 1984 PA 192 and a permit under the State Construction Code Act, 1972 PA 230.

  • House Bill 4737 of 2013 - Amends the Stille-DeRossett-Hale Single State Construction Code Act, 1972 PA 230, by adding section 28a to allow a system provider registered under the Security Alarm Systems Act, 2012 PA 580, or a security alarm system contractor under the Private Security Business and Security Alarm Act, 1968 PA 330, to install, maintain, replace, or service any electrical wiring, equipment, or devices related to or associated with a home monitoring system without requiring a permit.

  • House Bill 4743 of 2013 - Amends the Fireworks Safety Act which clearly references the compliance with the Michigan Building Code for all locations. It also allows for local municipalities to enact ordinances relating to ignition, discharge, and use of consumer fireworks for days and times of the day.

  • House Bill 4731 of 2013 - Amends Section 9 of the Firefighters Training Council Act to allow the State Fire Marshal to waive examination requirements for certain veterans, under the act.

  • House Bill 4756 of 2013 - Amends section 2404b of the Occupational Code to allow certain eligible members of the armed forces to substitute military experience for up to 60 hours of prelicensure education requirements toward a residential builders or residential maintenance and alteration contractor license.

  • House Bills 4334 and 4654 of 2013 - House Bill 4334 amends section 904(4) of the Limited Liability Company Act to allow physician's assistants to organize as a Professional Limited Liability Company.  It also amends section 904(7) to allow a professional limited liability company to be formed if more than 50% of the equity and voting are held "directly or beneficially" by licensed accountants.  House Bill 4654 amends section 284(5) of the Business Corporation Act to allow a professional corporation to be formed if more than 50% of the "equity and voting rights" are held "directly or beneficially" by licensed accountants.

  • House Bill 4156 of 2013 - Amends sections 16184 and 16185 of the Public Health Code by allowing retired health professionals to obtain a special volunteer license providing them with civil immunity when providing services for which they were previously licensed prior to retirement.  The health professional must apply for a special volunteer license before being able to practice.

  • House Bill 4752 of 2013 - Amends the Boiler Act of 1965 (PA 290 of 1965) to identify a training program offered to active duty boiler operators and stationary engineers in the armed forces as a qualified training program; waives the license and registration fees for those veterans that provided documentation of an honorable discharge or general discharge with honorable conditions.

  • House Bill 4754 of 2013 - Amends section 6 of the Forbes Mechanical Contractors Act (PA 192 of 1984), to allow experience gained within the armed forces that falls within certain classifications to be accepted for consideration to sit for examination for those veterans that provided documentation of an honorable discharge or general discharge with honorable conditions.

  • House Bill 4585 of 2013 - Amends the Occupational Code (PA 299 of 1980) to include specific reference to electronic seal and electronic signature in provisions applicable to the seal used by licensed architects, professional engineers, and professional surveyors.

  • House Bill 4242 of 2013 - Amends the Administrative Procedures Act (APA) to require the Regulatory Impact Statement submitted by an agency also include information demonstrating "that the proposed rule is necessary and suitable to achieve its purpose in proportion to the burdens it places on individuals.  This amendment also clarifies a previous requirement of the Regulatory Impact Statement to identify the nature of "required" reports, and estimates the cost of the reports on small businesses.

  • House Bill 4125 of 2013 - Repeals sections 2, 3 and 4 of the State School of Osteopathic Medicine (PA 162 of 1969) by eliminating the Osteopathic Medicine Advisory Board.

  • House Bill 4208 of 2013 - Amends sections 2 and 6 of the Resort District Rehabilitation Act (PA 59 of 1986) by permitting a township to establish a resort district authority, a public body corporate, to implement a district rehabilitation plan to improve the district amenities for tourism.  The Act provides for creation of a resort district a portion of which is land that is or was part of a summer resort association incorporated under one of the four summer resort and assembly association acts listed in the bill.

  • House Bill 4996 of 2013 - Amends the Uniform Securities Act (PA 551 of 2008) by allowing an exemption to an offer or sale of a security by an issuer from requirements under sections 301 to 306 and 504 of the Securities Act (PA 551 of 2008).

  • House Bill 4277 of 2013 - Amends section 525 of the Michigan Liquor Control Code of 1998 to require the Michigan Liquor Control Commission to issue a nontransferable and nonrenewable conditional license to certain applicants within 20 business days after the applicant files a completed application and a completed conditional license request form and documentation along with a fee.  It also provides the conditional license will expire when the Commission issues a final order approving or denying the license application, the licensee or applicant requests cancellation of the initial application, or 1 year after the date the conditional license was issued, whichever occurs first.

  • House Bill 5046 of 2013 - Amends section 1021 of the Michigan Liquor Control Code of 1998 to allow individuals to bring wine into a licensed establishment that was not purchased from a person licensed to sell beer, wine, spirits, and mixed spirit drink for consumption on the licensed premises (on premises licensee) and consume that wine on the licensed premises.

  • House Bill 4709 - Amends section 109 of the Michigan Liquor Control Code of 1998 to revise the definition of "micro brewer" by increasing the maximum production of beer from 30,000 barrels to 60,000 barrels and including the ability of a micro brewer to sell beer produced by it to retailers as provided in section 203 of the Code.

  • House Bill 4710 of 2014 - Amends section 603 of the Michigan Liquor Control Code of 1998 to allow a brewpub to have an interest in up to five other brewpubs and to increase the combined production of all the locations in which the brewpub has interest from 5,000 barrels to 18,000 barrels.

  • House Bill 4711 of 2014 - Amends section 411 of the Michigan Liquor Control Code of 1998 to allow a brewer not licensed as a micro brewer to sell its beer for on premise consumption at two locations on its licensed brewery premises; to allow a micro brewer that produces less than 30,000 barrels of beer per year to sell its beer for on premise consumption at any brewery licensed premises; and to allow a micro brewer that produces 30,000 barrels or more of beer per year to sell its beer for on premises consumption at not more than three licensed brewery locations.

  • House Bill 4484 of 2014 - Amends the Self-Service Storage Facility Act (PA 148 of 1985) to better define processes for storage facility owners in disposing of certain property left in storage units for which rental payments are in default.

  • House Bill 5282 of 2014 - Creates the Security Act for Nuclear Energy, which clarifies that security forces at nuclear generating facilities are able to use the same level of force in protected areas of nuclear generating facilities that a citizen may use to protect a home or business.

  • House Bill 4732 of 2013 - Amends Section 2(a) of the Construction Code Act, PA 230 of 1972, to exempt a qualifying roadside stand from plumbing fixture requirements and not require it to have electric power; however, if the qualifying stand had electric power it must comply with the electric code.  Also exempts a tent from the act and code if it met part of the requirements for the definition of a "qualifying roadside stand".

  • House Bill 4355 of 2013 - Amends Section 57 of the Condominium Act, PA 59 of 1978, requiring certain associations to have their financial books and records audited or reviewed by a Certified Public Accountant.  There is also a provision added for associations to exempt themselves from the annual audits.

  • House Bill 4303, 4329 and 4330 of 2013 - House Bill 4303 amends the Occupational Code, PA 299 of 1980, House Bill 4329 amends the State License Fee Act, PA 152 of 1979, and House Bill 4330 amends the Public Health Code, PA 368 of 1978.  Together these bills provide for issuance of courtesy licenses for the practice of mortuary science, requires a license fee and gives them the ability to certify a death record.

  • House Bill 4937 - Amends the Julian-Stille Value-Added Act by eliminating the requirement for investor-owned utilities that have annual uncollectible expenses below a certain amount to have to make contributions to the Clean Air Fund housed in the Department of Environmental Quality (DEQ).

  • House Bills 4949 - 4954 - This six bill package amends the Michigan Employment Security Act, PA 1 of 1936, to ensure Michigan law conforms with new Federal rules by providing greater power for the Unemployment Insurance Agency to recover improperly paid unemployment benefits made as a result of fraudulent claims, charges an employer who fails to provide required information and changes how recovered funds are credited.

  • House Bill 4958 - Amends Sections 26a, 42 and 43 of the Michigan Employment Security Act, PA 1 of 1936, excludes services performed by certain individuals working under J-1 and H-2B Visas from "employment" under the statute, such that employers would not pay state unemployment taxes on wages paid for such services and required to provide supporting documentation to the Unemployment Insurance Agency.  Section 43(V) exempts services for "employment" performed by oil, gas, or mineral landmen under contract with a private person or private entity for which the contract provides the individual is an independent contractor and not an employee from paying Federal Unemployment Tax.

  • House Bill 5487- Amends Subsection 551 of the Workers Disability Compensation Act, PA 317 of 1969, by providing for an assessment mechanism to allow the SISF to address the unpaid claims that are a result of the Delphi bankruptcy.  It will insure the integrity of the workers' compensation self-insurance system.  Annual reporting will be required by March 31, 2015 and every year after.  Also prescribes certain late fees and penalties for delinquent assessments and will sunset the assessment of private group self-insurers on behalf of the SISF after December 31, 2019.

  • House Bill 5488 - Amends Subsection 555 the Workers Disability Compensation Act, PA 317 of 1969, which restricts reimbursement to any carrier that is delinquent in paying assessments.

  • House Bill 5489 - Amends Subsection 537 of the Workers Disability Compensation Act, PA 317 of 1969, by allowing trustees to authorize payments from the SISF (Self-insurers' Security Fund) requested by a disabled employee, or his or her dependent, if the employee were entitled to benefits arising out of employment between May 28, 1999, and October 7, 2009, with a bankrupt employer.  Allows the SISF to redeem any claim by a former employer against a self-insured employer if the claimant voluntarily agreed, SISF would be entitled to reimbursement from a carrier for benefit payments it made to such an employee or his or her dependent, if a court judgment specified that carrier was responsible for payment.

  • House Bill 5248 - Amends the Public Health Code, PA 368 of 1978, by waiving the application processing and licensing fee (a total of $20) for an applicant who is applying for an initial license as a dental assistant if the applicant served as a "military dental specialist" while on active duty and who separated with an honorable character of service or under honorable conditions (general) character of service from the armed forces.

  • House Bill 5798 of 2014 - Amends several sections of the Michigan Liquor control Commission Act (MLCCA), PA 58 of 1998, by  including powdered alcohol and items fit for food purposes that contain 1/2 of 1% or more of alcohol to provide the appropriate regulation for these substances in keeping with the regulations for all alcohol.  Also made statutory updates to take advantage of the technological updates of digital fingerprints rather than continuing to use the paper fingerprinting card.  Increases the barrel threshold from 5,000 to 18,000 barrels in the definition of "brewpub" to be consistent with recent statutory changes in 2014, PA 43.  Also includes changes to conditional licenses by clarifying that a conditional license for the transfer of an existing license at the same location includes any existing permits and approvals held in connection with that license.  Includes keg couplers and sporting event or entertainment tickets as items that may be provided to licensees by manufacturers, suppliers, and wholesalers which were inadvertently omitted from 2014 PA 47.

  • House Bill 5273 - Amends the 2002 Uniform Securities Act, PA 551 of 2008, to provide for the registration and regulation of Michigan Investment Markets (MIMs), formerly known as Local Stock Exchanges that will essentially be intrastate broker-dealers (BDs) that facilitate the buying, selling, and trading of intrastate offerings.  Offerings and participating in the MIMs are limited to residents of Michigan.

  • House Bill 5097 - Amends section 15b of the Public Employment Relations Act (PERA) PA 312 of 1969, by excluding public employees (police and fire) who are eligible for compulsory arbitration under PA 312 of 1969.  Removes restrictions to prohibit paying increases in wages and benefit costs between contract expiration and the effective date of a successor agreement, parties from agreeing to retroactive wage increases, and arbitrators from ordering retroactive increases.

  • House Bill 4890 - Amends the Rural Cemetery Corporations Act, 1869 PA 12 or the Cemetery Corporations Act, 1855 PA 87, by adding section 17 to the Cemetery Regulation Act creating a procedure to declare a burial right abandoned and to transfer that burial right back to the cemetery or to another person, under certain conditions.

  • House Bill 5397 - Creates the Municipal Utility Residential Clean Energy Program Act, to allow municipal electric utilities to establish residential clean energy programs to finance energy efficiency improvements or renewable energy installations undertaken by residential customers, and to allow those customers to pay off the costs of such projects in monthly installments on their electricity bill.

  • House Bill 5860 - Amends the Occupational Code, PA 299 of 1980, section 26 regarding appraisers, to conform to Federal requirements.  The bill modifies the definition of "AQB criteria", "limited real estate appraiser", and "Uniform Standards of Professional Appraisal Practice". Amends section 2605 to require a licensee utilize the Uniform Standards of Professional Appraisal Practice (USPAP) that are in effect at the time the licensee is engaged to perform the appraisal and to eliminate the outdated reference to the Appraisal Qualifications Board (AQB) criteria.

  • House Bill 5806 - Amends the Community College Act to allow the term of installment contracts or notes issued to finance energy conservation improvements to last up to 25 years.  Current law caps the length of the contracts at 10 years.

  • House Bill 5714 - Amends the Motor Carrier Act to implement changes in the application process used by intrastate for-hire- motor carriers that will eliminate unnecessary regulations and allow for certificates of operating authority to be issued up to 67 percent more quickly.

  • House Bill 5389 - Amends the Public Health Code, PA 368 of 1978, by adding section 21794 which allows nursing homes to use dining assistants to provide feeding assistance to certain patients.  The bill requires LARA's Bureau of Health Care Services, in conjunction with the Long Term Care Stakeholder Advisory Workgroup, to create a "Dining Assistants Training Curriculum."  Nursing homes that choose to utilize dining assistants are responsible for providing department approved training to those individuals hired as dining assistants.  Individuals must complete the approved training and are subject to a criminal background check prior to services being provided to patients.
