To reduce the risk of both the transmission and a resurgence of COVID-19, it is necessary to continue to conduct administrative hearings by remote means. It is also necessary, where not otherwise authorized by the use of an electronic filing system or specifically authorized by an administrative law judge or executive director order, to allow for email acceptance of all administrative hearing filings with the Michigan Office of Administrative Hearings and Rules (MOAHR). These measures are authorized by Rules 121 and 109 of the Mich Admin Code, R 792.10121 and R 792.10109, respectively, and by Emergency Rule Amending Rule 101, R 792.10101, and are effective through July 12, 2021, subject to further extension.
To further assist remote hearing participants, MOAHR has developed a Standards and Guidelines for Remote Hearings manual, which contains useful information and best practices relevant to the conduct of remote hearings for all practice areas within MOAHR, except for the Corrections area and the Michigan Tax Tribunal. The Michigan Office of Administrative Hearings and Rules (MOAHR), created by EO 2019-06 and modified by EO 2019-13, is a Type I agency within the Department of Licensing and Regulatory Affairs.
MOAHR includes a centralized administrative hearing system with several divisions of administrative law judges, the Michigan Tax Tribunal, and the office that oversees administrative rulemaking for all state departments.
