Liquor Licenses of Detroit and Clarkston Businesses Suspended

January 18, 2019 - At the Michigan Liquor Control Commission hearing yesterday in Southfield, commissioners ordered the suspension of the liquor license and permits held by two Southeast Michigan businesses:

  • JEMM Investments, Inc. – doing business as The Detroiter Bar – located at 655 Beaubien Street in Detroit, Michigan.

  • Walgreen Co. – doing business as Walgreens – located at 7110 Dixie Highway in Clarkston, Michigan

Under state law, the Commission is required to impose a suspension or revocation of the liquor license if a licensee is found liable for three or more violations of MCL 436.1801(2) – sales of alcohol to minors and sales of alcohol to visibly intoxicated persons – on different occasions within a 24-month period.

The violations committed by The Detroiter Bar occurred on August 4, 2016, September 8, 2017 and June 3, 2018. The minor(s) who were sold alcoholic liquor were all 19 years of age. While identification was not requested in two of the incidents, ID was requested in the June 3, 2018 incident involving two decoy minors. The ensuing violation indicated either a careless disregard of the law or deliberate actions of the bartender.

The violations committed by Walgreens occurred on September 7, 2017, November 21, 2017 and July 13, 2018. The minor(s) who were sold alcoholic liquor on these dates were 19 and 20 years of age. In the July 13, 2018 incident, the clerk asked the decoy for ID and when the decoy did not produce identification the clerk then asked the minor for their date of birth, entered it into the cash register, and the sale was completed.

At the hearing yesterday – after reviewing the records and files for each company, and hearing arguments from both license holders – the Commission ordered a 21-day license suspension for The Detroiter Bar and a 5-day license suspension for Walgreens:

  • The Detroiter Bar will serve their suspension from Thursday, January 24, 2019 through Wednesday, February 13, 2019.

  • Walgreens will serve their suspension from Monday, January 28, 2019 through Friday, February 1, 2019.

"It is imperative that our licensees do not sell to minors in any circumstance,” said MLCC Chairman Andy Deloney. “According to the state liquor control code, the Commission is required to suspend or revoke a license in situations like this in order to protect the health, safety, and welfare of the public. After reviewing both files, the unique fact patterns for each, and considering the entirety of the records in the hearings, the Commission felt that revocation of the licenses wasn’t warranted, but rather determined that ordering these suspensions was appropriate."
