LARA Issues Cease and Desist Order Against Dimondale and Mulliken Funeral Homes

March 4, 2020 – On March 2, 2020, the Dept. of Licensing and Regulatory Affairs (LARA) issued cease and desist orders and formal complaints against the funeral establishment licenses of Barker-Leik Funeral Home, located at 2341 Grand Ledge Highway in Mulliken, and Field & Leik Funeral Home, located at 122 West Washington in Dimondale – and the licenses of their designated managers – for violations of the Occupational Code for engaging in the practice of mortuary science without possessing active mortuary science establishment licenses issued by LARA’s Corporations, Securities & Commercial Licensing bureau (CSCL) and for misrepresentations on the establishments’ 2017 license renewal applications.

CSCL’s action follows an investigation into Barker-Leik and Field & Leik Funeral Homes; both of which have not held a registration under the Prepaid Funeral and Cemetery Sales Act since 1996. Neither establishment had a contract with another registrant under the Prepaid Act at the time each establishment certified that at least one of those circumstances existed on their 2017 establishment license renewal applications, constituting the practice of fraud or deceit in obtaining a license. Field & Leik submitted an incomplete application to reinstate its registration under the Prepaid Act in October 2019, but it remains incomplete to this date.

On October 31, 2019, both establishments’ funeral establishment licenses lapsed due to expiration and remain in that status to date. Barker-Leik’s manager and owner, Donald H. Leik, and Field & Leik’s manager, Michael Mills, Jr., were also accused of aiding and abetting the establishments in the unlicensed practice of mortuary science. A designated manager is responsible for the operation and management of a funeral establishment, including ensuring its compliance with the Occupational Code.
