What is eminent domain?
The right of government to take private property for public use. Private property shall not be taken for public use without just compensation therefore being first made or secured in a manner prescribed by law. A condemnation action is the legal action taken by government to acquire private property for public use (exercising eminent domain power).Legal counsel recommendation
It is highly recommended to obtain legal counsel with condemnation (eminent domain) experience. Failure to do so may result in project costs that are not eligible for state or federal funding.
