The Land Division Act 288 of 1967 and the Condominium Act 59 of 1978 requires that developers, owners, or proprietors notify the MDOT and other state and local governments of their intent to develop a subdivision plat or condominium project in the State of Michigan. These instructions describe the information that must initially be provided to MDOT and the steps MDOT will take once the information is received.
Provide the appropriate MDOT Transportation Service Center (TSC) with one copy of the preliminary plat in hard copy or electronic PDF format.
Within 30 calendar days after receipt of the preliminary plat, MDOT TSC staff will conduct a review of the preliminary plat submittal and provide a determination whether MDOT has “Authority” or “No Authority” over the plat. Once a determination has been made, MDOT staff will notify the proprietor via e-mail along with an attached letter. This letter will provide additional information and instructions regarding the next steps of the process, which may include necessary improvements to MDOT's road system, as part of the plat development.
Provide the TSC with one copy of Notice of Proposed Action in hard copy or electronic PDF format.
When the Notice of Proposed Action is received by the MDOT, TSC staff will ensure that it includes the necessary content described above. MDOT's review will determine if the proposed condominium project is abutting to or has access to a state trunkline roadway and if the condominium project would necessitate improvements to the MDOT road system, as part of the condominium project. If improvements are necessary, MDOT TSC will inform the condominium developer of the required improvements, as well as the permit process required to be completed prior to initiating condominium project construction activities impacting the MDOT right of way.
